Terms of Service

Please read these Terms of Service ("Terms") carefully before using the VIB AI mobile application (the "Service" or "App") operated by VIB AI ("we," "us," or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.
1. Description of Service
VIB AI is a mobile application that provides AI-powered chat, AI agent functionality, and optional subscription-based premium features.
User inputs ("User Input") may be processed by one or more third-party AI model providers or AI infrastructure providers selected by us or made available within the App. Depending on the model you use, these providers may include OpenAI, Google, Anthropic, xAI, DeepSeek, ByteDance, Alibaba Cloud / Tongyi Qianwen, Tencent Hunyuan, Moonshot AI (Kimi), MiniMax, Zhipu AI (GLM), and other comparable providers. Model and provider availability may change from time to time.
To help the AI understand your requests, the App may temporarily access information about your screen content, which may include descriptive text, screenshots, or screen recordings that you voluntarily provide or authorize. Except where you separately submit such information as part of a support or problem report, this temporary screen content is processed only as needed to provide the requested service and is deleted after processing.
AI-generated responses may be inaccurate, incomplete, outdated, or unsuitable for your specific situation. They do not constitute legal, financial, medical, or other professional advice. You are solely responsible for reviewing, verifying, and supervising any outputs generated by the Service.
2. Use License
Subject to your compliance with these Terms, VIB AI grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App for your personal, non-commercial use on devices that you own or control.
If you download or use the iOS version of the App through the Apple App Store, your use may also be subject to Apple's Standard Licensed Application End User License Agreement ("Apple Standard EULA"), available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
To the extent required by Apple platform rules, the Apple Standard EULA applies between you and Apple with respect to the licensed iOS application. If there is a conflict between these Terms and any non-waivable provision of the Apple Standard EULA applicable to the iOS App, the applicable non-waivable Apple provision will control solely to the extent of that conflict.
3. User Responsibilities and Conduct
You acknowledge and agree that you are solely responsible for all User Input you provide to the App and for your use of any output generated by the Service.
You agree not to use the App to:
- Violate any applicable law, regulation, court order, or third-party right.
- Submit unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, fraudulent, or otherwise objectionable content.
- Submit content that infringes or misappropriates any patent, trademark, trade secret, copyright, privacy, publicity, or other rights of any person or entity.
- Misrepresent your identity or affiliation with any person or entity.
- Transmit malware, malicious code, or other harmful material.
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any part of the App, its servers, networks, or related systems.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying models, or underlying algorithms of the App, except to the extent such restriction is prohibited by applicable law.
- Use the App for commercial purposes without our prior written consent.
You must use the App under your direct supervision and control and must not leave the App operating unattended.
4. Intellectual Property
The App, including its design, software, text, graphics, features, and functionality, excluding User Input and user-owned content, is owned by VIB AI or its licensors and is protected by applicable intellectual property and other laws.
You retain ownership of the User Input you submit, subject to the rights you grant to us under these Terms.
By submitting User Input to the Service, you grant VIB AI a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, use, reproduce, modify, process, and display that User Input solely as necessary to operate, provide, secure, support, and improve the App.
As between you and VIB AI, you are responsible for determining whether you may use, rely on, share, or commercialize any AI-generated output.
5. Third-Party Services
The Service relies on third-party services to operate, including:
- AI model providers and AI infrastructure providers that process your prompts, chat content, and related service data to generate responses and provide AI functionality.
- Apple App Store and Google Play, which may process subscription purchases, renewals, cancellations, refunds, taxes, and payment-related operations through Apple In-App Purchase or Google Play Billing.
- Analytics, attribution, cloud, security, customer support, and other operational service providers that help us run, secure, and improve the App.
When you use third-party services through the App, your use of those services may also be subject to the third party's own terms, privacy policy, and platform rules. We are not responsible for the content, availability, or practices of third-party services.
6. Subscription and Payment
6.1 Subscription Plans
The App may offer optional auto-renewing monthly and yearly subscriptions through Apple In-App Purchase on iOS devices and Google Play Billing on Android devices.
Subscription is not required to access all App functionality, but an active subscription may be required to access certain premium features or higher service levels.
6.2 Subscription Benefits
An active subscription may unlock premium AI services, such as higher message or energy allowances, access to advanced or premium AI models, priority access during high-demand periods, and earlier access to selected new features.
Subscription benefits may vary by version, jurisdiction, platform, device capability, account status, technical constraints, or commercial arrangements. We do not guarantee that any specific model, feature, quota, response speed, or benefit will remain available indefinitely.
6.3 Pricing and Purchase Display
Actual prices, currencies, taxes, billing periods, and purchase terms are shown to you in the App's subscription screen and the applicable Apple or Google checkout flow at the time of purchase.
If there is any difference between a general description in the App or on our website and the platform checkout screen, the platform checkout screen and the applicable platform rules will control for billing purposes.
6.4 Automatic Renewal
Unless cancelled, subscriptions renew automatically at the end of each billing period.
By purchasing an auto-renewing subscription, you authorize the applicable platform provider to charge your Apple ID or Google Play account for recurring subscription fees in accordance with the plan selected by you and the platform's billing practices.
The platform may attempt to charge for renewal within 24 hours before the end of the current billing period, subject to the platform's own billing processes and applicable law.
6.5 Cancellation
You may cancel your subscription at any time through your Apple account settings or Google Play account settings, depending on where the subscription was purchased.
Cancellation stops future renewal charges but does not retroactively cancel the current paid billing period. You will generally continue to have access to subscription benefits until the end of the period you already paid for.
VIB AI does not directly process subscription cancellations for App Store or Google Play purchases.
6.6 Restore Purchase
If supported by the platform and the App, you may use the App's "Restore Purchase" function, or another platform-supported restore mechanism, to restore access to an eligible active subscription associated with the same platform account.
Restore Purchase only restores valid and recoverable purchases recognized by the applicable platform. It does not create a new subscription, extend a subscription term, or restore purchases that are expired, refunded, revoked, charged back, fraudulent, or otherwise ineligible under platform rules.
6.7 Refunds, Billing Issues, and Chargebacks
All refunds, billing disputes, chargebacks, and payment-related requests for subscriptions purchased through Apple App Store or Google Play are handled by the applicable platform provider in accordance with its policies and procedures.
VIB AI does not directly issue refunds for in-app subscription purchases processed by Apple or Google.
If a chargeback, refund, payment failure, or revocation is reported to us by the applicable platform, we may suspend or remove access to related subscription benefits.
6.8 Subscription Data and Records
We do not receive, collect, or store your full payment card details.
We may receive and retain limited subscription and transaction metadata from Apple or Google, such as subscription status, product or plan type, order or transaction identifiers, purchase date, renewal date, expiration date, cancellation status, restore status, amount, currency, country or storefront information where available, and platform source.
We use this information only to verify subscription status, provide or restore paid features, resolve billing or technical issues, prevent fraud or abuse, maintain business records, and comply with legal, accounting, tax, audit, and regulatory obligations.
6.9 Changes to Subscription Offerings
We may change subscription plans, pricing, features, included models, availability, or eligibility from time to time, subject to applicable law and applicable Apple or Google platform rules.
Where required, material changes will be presented through the App, the applicable platform, or another legally sufficient notice method. Your statutory consumer rights are not limited by this section.
6.10 Effect of Account Deletion or Termination
Deleting your account or uninstalling the App does not automatically cancel an active subscription. You must manage cancellation through the platform where the subscription was purchased.
Account deletion or termination does not require us to delete subscription, transaction, tax, accounting, audit, fraud prevention, security, or legal compliance records that we are required or permitted to retain under applicable law.
7. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, secure, or available at any particular time or location, or that any AI-generated output will be accurate, reliable, complete, or suitable for any purpose.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIB AI, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, LICENSORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, ANY AI OUTPUT, OR ANY SUBSCRIPTION OR BILLING MATTER.
To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Service will not exceed the greater of the amount you paid to us or through the App for the Service in the 12 months before the event giving rise to the claim, or USD $50.
9. Indemnification
You agree to defend, indemnify, and hold harmless VIB AI, its affiliates, officers, directors, employees, agents, licensors, and partners from and against any claims, demands, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- Your access to or use of the Service.
- Your User Input or your use of any output generated by the Service.
- Your violation of these Terms, applicable law, or any third-party right.
- Any unauthorized, fraudulent, or unlawful use of your account or subscription.
10. Termination
We may suspend or terminate your access to the Service, in whole or in part, immediately or at any time, with or without notice, if we believe that you have violated these Terms, created risk or legal exposure for us or others, engaged in fraudulent or abusive activity, or if suspension or termination is otherwise necessary to protect the App, our users, or third parties.
Upon termination:
- Your right to use the Service will immediately end.
- You must stop using the Service.
- We may disable access to your account, content, or subscription benefits, subject to applicable law and platform rules.
Termination does not affect accrued rights, obligations, or liabilities, including payment obligations, retention obligations, or provisions that by their nature should survive termination.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws applicable in your place of residence, except to the extent otherwise required by mandatory consumer protection law.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
12. Dispute Resolution
If you have a dispute or claim arising out of or relating to these Terms or the Service, you agree to first contact us at support@vibai.com and attempt to resolve the matter informally.
If you are located in the European Union, you may also be entitled to submit certain disputes through the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr, subject to availability and applicable law.
Nothing in these Terms limits any non-waivable consumer rights or remedies you may have under applicable law.
13. Changes to Terms
We may modify these Terms from time to time.
When required, we will provide notice of material changes through the App, on our website, or by another appropriate method. The updated Terms will become effective on the date stated in the updated version or, if no date is stated, when posted.
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the Service.

15. Entire Agreement
These Terms constitute the entire agreement between you and VIB AI regarding the Service and supersede all prior or contemporaneous agreements, communications, and understandings relating to the same subject matter, except where additional terms apply under mandatory platform rules or applicable law.
